The public hearing to discuss the revision of Articles 2 and 5 of Resolution No. 414/2010, dealing with definitions and classifications relating to rural consumers, starts on Wednesday (08/17). The hearing will discuss only the articles that refer to the classification of rural consumption.
Resolution No. 414/2010 updated Resolution No. 456/2000, regarding the general conditions of electricity supply. With the upgrade, definitions of article 2 were introduced, with effect only in the context of the Resolution, of the terms of subsistence agriculture, livestock and aquaculture. And from the contributions received from stages of the hearing and public consultation that preceded the publication of the regulations of 2010, § 4 of Article 5, which deals with the rural classification, was revised.
However, after the adoption of the Regulation, the National Energy Agency (ANEEL) received several questions, criticisms and suggestions in this regard. For this reason, the Agency decided to open a new hearing process for further examination on the subject.
Among the critiques are the restrictive aspects of the definitions introduced by the new regulation framework for the rural underclass, and the classification of properties that grow crops in rotation or more than one culture, intended or not for food production. Notes stating that changes made would be reflecting on Tax on Goods and Services (ICMS) rates, collected from the affected units, were also presented.
