Those interested in participating in Transmission Auction No. 004/2011, sponsored by the National Energy Agency (ANEEL) on 09/02, at 10am, at the headquarters of the BM&FBovespa, in São Paulo, must register from 8am on Tuesday (08/30) to 2pm on Wednesday (08/31).
The deadline for contributions to proposals goes from 9am on 08/30 to 4pm on 08/31. Guarantees do not have digital certification and those under deposit account must be contributed on 08/31, until 4pm. The Special Licensing Committee (CEL) of the agency will issue a relevant statement with the name of the tenderers eligible for the auction on Thursday (09/01).
The Transmission Auction No. 004/2011 will bid 12 lots of 2,051 kilometers (km) of transmission lines and substations to 6900 Mega-volt-ampere (MVA) of power. The new facilities will demand investments of BRL 2.8 billion in 13 states, generating 11,600 direct jobs.
The period of completion will be 18 to 36 months and the concession contracts are of 30 years. The maximum Annual Revenue Allowed (RAP)* to be paid to entrepreneurs, determined in the announcement, is BRL 341.2 million. The winners will be the bidders who submit the lowest RAP value per lot.
In this auction, all 12 lots contain 14 lines and 12 substations in the states of Roraima, Pará, Mato Grosso, Goiás, Paraná, Minas Gerais, Piauí, Pernambuco, Bahia, Rio de Janeiro, São Paulo, Alagoas and Paraíba. See here the details of the lots.
The enterprises that make up Lot E and previously integrated Lot D of Auction no. 008/2010-ANEEL was withdrawn from that event, after identifying the need to review the extent of 230 kV Cascavel Oeste–UmuaramaTransmission Line, supported also by the postponement of the date of the project need from 2011 to 2013. The installation of Lot D was also previously bid, integrating Lot E of Auction no. 008/2010-ANEEL, but on occasion, there was no bidder for the lot. The project was reviewed and will be re-bid in this auction.
Systematic Auction – The financial proposal with the Annual Revenue Allowed (RAP) value for each lot shall be submitted in a sealed envelope by the participant. If the difference between the lowest bid and other bids is greater than 5%, the lowest bidder wins the tender. If the difference is less than or equal to 5% or if there is a tie among the lowest bids, there will be a round on speakerphone, in which the auctioneer may set minimum values to be provided between a bid and others. The winner will be the tenderer submitting the lowest value. In case any bidder bids on speakerphone, the winner will be who has submitted the lowest per envelope. If there is a tie in values presented per envelope without bids on speakerphone, the winner will be determined by a draw promoted by the director of the session.
Guarantees – To participate in the auction, bidders landed guarantee of 1% of the investment value estimated by ANEEL. The Performance Bond is provided only by the winners of the auction, replacing the previous guarantee. It corresponds to 5% of the investment and should be contributed within two business days before signing the contract.
Schedule – On the schedule of the notice published in the Official Journal on 08/03, the winning bidders must submit the documents for the qualifying phase on September 13, from 9am to 2pm, at the BM&FBovespa, in São Paulo. On the 23rd, the Special Licensing Committee (CEL) of ANEEL should disclose the results of the qualification. The result of the approval and awarding of the concession is planned for October 11, 2011. The deadline for delivery on schedule and on budget construction of the facility is November 10, when it should also be given the documents of the Special Purpose Company (SPC) or the transmission concessionaire required to award the contract and concession. The award may occur until 30 days after delivery of such documents. Two days before the date to be set for signing the concession contract, entrepreneurs must submit a performance bond.

*Annual Revenue Allowed (RAP) – it is the annual revenue that the bearer is entitled to for the provision of public transmission service to users as from the start of commercial operations of the facility. Its value is that obtained as a result of the auction, with annual update of the Consumer Price Index (IPCA) of the Brazilian Institute of Geography and Statistics (IBGE) and review every five years under a concession contract.
