The Brazilian Electricity Regulatory Agency (ANEEL) will hold Transmission Auction no.004/2011 this Friday (9/2), at 10:00 am, at the BM&FBovespa headquarters in São Paulo.Sixteen companies and six consortiums are qualified to dispute 12 lots comprised of 2,051 kilometers (km) of transmission lines and substations with 6900 Mega-volts-amperes (MVA) of power.Accompany transmission of the auction live and information about the results for each lot on the ANEEL website (www.aneel.gov.br).
The new installations will demand investments of around R$ 2.8 billion in 13 states, generating 11.6 thousand direct jobs.The maximum Permitted Annual Revenue (RAP)* to be paid the businesses, as determined in the edict, is R$ 341.2 million.Those tenderers who present the lowest RAP value per lot will be declared the winners.Go to companies enabled to participate in the auction.
At this auction, the 12 lots contain 14 transmission lines and 12 substations in the state of Roraima, Pará, Mato Grosso, Goiás, Paraná, Minas Gerais, Piauí, Pernambuco, Bahia, Rio de Janeiro, São Paulo, Alagoas and Paraíba. The enterprises that comprise Lot E were previously part of Lot D and Auction no.008/2010-ANEEL, which was removed from that tender after identifying the need to review the extension of the 230 kV Cascavel Oeste–Umuarama Transmission Line, further supported by postponement of the date by which the enterprise would be needed from 2011 to 2013. Installation of Lot D was also tendered previously as part of Lot E, Auction no.008/2010-ANEEL, but on the occasion there was no tenderer for the lot.The enterprise was reevaluated and it will be part of this auction’s tender.
Auction systematics –The financial proposal with the value for the Permitted Annual Revenue (RAP) for each lot will be presented by the participant in a sealed envelope.If the difference between the smallest tender and the other proposals exceeds 5%, the lowest tender wins.If the difference is smaller than or equal to 5%, or if there is a tie between the lowest tenders, there will be an open auction in which that auctioneer can set minimum values to be offered between one bid and another.The tenderer who offers the lowest value will win.In the event no tenderer makes an open auction bid, the winner will be the one who presented the lowest sealed bid.If there is a tie between the values in the sealed bids, without presentation of open auction bids, the winner will be determined by a drawing held by the session director.
Guarantees –In order to participate in the tender, the tenderers entered with a guarantee worth 1% of the investment sum estimated by ANEEL.The Guarantee of Faithful Compliance is presented only by auction winners, replacing the prior guarantee.It corresponds to 5% of investment value and should be paid up to two workdays before signing of the contract.
Timetable –According to the edict timetable published in the Official Daily Gazette of 8/3, the winning tenderers should deliver the documents for the qualification phase on September 13, from 9:00 am to 2:00 pm, at BM&FBovespa, in São Paulo.On the 23rd, ANEEL’s Special Tender Commission (CEL) will disclose the qualification result.Ratification of the result and awarding of the concession are projected for October 11, 2011. The deadline for delivery of the timetable and the installation construction budget is November 10, the date on which the documents of the Specific Proposal Society (SPE) or the transmission concessionaire, required for approval and for the concession contract shall be delivered.Approval may occur up to 30 days after delivery of these documents.Two workdays prior to the date to be set for signing the concession contract, the business owners should deliver the guarantee of faithful compliance.

*Permitted Annual Revenue (RAP) – is the annual revenue to which the transmitter will have rights for providing the public transmission service to users, starting with the commercial operations at the installations.The value is the one obtained as a result of the auction, updated annually by the Broad-based Consumer Price Index (IPCA) of the Brazilian Institute of Geography and Statistics (IBGE) and reviewed every five years, as per the terms of the concession contract.
