The board of the National Energy Agency (ANEEL) decided on Tuesday (09/06), during a public meeting, to establish public hearing (AP no. 049/2011) in order to revisit Resolution No. 414/2010, and especially Article 218, which establishes the timing for the distributors to prove the sending of the proposed transfer of assets of public lighting for the municipal government of its concession area.
The original deadline, which was July 2011, was extended to October 2011 because of allegations regarding the distribution of the complexity and difficulty for accounting and transfer of assets and preparation of the report required in the resolution. With the public hearing, the period was suspended. At the meeting this Tuesday, representatives of local governments asked the agency to suspend the obligation to transfer assets. Mayors show a lack of financial conditions by the municipalities to pay for the maintenance of public lighting infrastructure. However, a survey conducted by ANEEL in June shows that 63.8% of the country's cities already account for the assets, while in the remaining 36.2%, the transfer has yet to be accomplished. With the transfer of public lighting, which encompasses the design, implementation, expansion, installation, maintenance and energy consumption, the Agency tried to reduce costs to the consumer, since the rate is more expensive when the assets belong to the distributors. In addition, the Constitution of 1988 stipulated that street lights are responsibility of the municipality and, therefore, it allows the collection of the contribution of street lighting (CIP).
Public lighting is one of the subjects of the Public Hearing approved, which aims to revisit Resolution No. 414/2010. To discuss the street lighting issue, the period of the hearing will go from Sept. 9 to Dec. 9, with four onsite sessions in capitals Manaus (AM), on 10/27, Recife (PE), on 11/04, São Paulo, on 11/17, and Brasilia, on 11/23.
