Public Hearing no.048 for receiving contributions to the regulation that contemplates the constitution of guarantees by the electricity generation, transmission and distribution concessionaires, permissionaires and authorized firms is now open.

The proposal is focused on liquidity risk and thus seeks to establish rules to check concession and permission operation safety.Thus, the Agency understands that the offer of guarantees cannot be excessive to the point of compromising service operations.

The draft at the hearing consolidates procedures currently carried out in face of existing provisions in laws, decrees and authorizations; it establishes a self-applicable limit by distributors (dismissing prior consent due to the compulsory nature of some guarantees), and reinforces prohibitions (assets tied to the service and others).

Furthermore, the proposal in question regulates instruction of the process on the part of interested parts, granting greater speed and safety to decisions made by this Agency, and it dismisses prior consent for guarantee offers in support of Decree no. 2.003/1996.
