The collegiate board of the Brazilian Electricity Regulatory Agency (ANEEL) approved changes in Normative Resolution no.411/2010, which deals with adjustment auctions* for buying electricity.The main change is to consider the Annual Reference Value (VR)** in effect the year the contracted energy began to be delivered as the maximum price for adjustment auctions, in consonance with the tariff transfer pricing rule, and not the VR for the year the auction is held.
The objective of this measure is to ensure the transfer of electricity acquisition costs to the tariffs at the auction.If an auction was held with the negotiation of a product where supply would begin the following year, there could be, as per the old rule, a difference between maximum price and transfer value.In this context, the distributor would have to incur the price difference.This decision was made at the board meeting held last Tuesday (9/13).
This decision alters the reading to article 4 of Resolution no.411/2010. It was established that the starting price for each product will correspond to the minimum Difference Settlement Price (PLD_min) value, in effect the year the auction was held, as defined in the regulation, and the maximum price may not be the VR in effect the year contracted energy supply begins.
Furthermore, if the auction takes place in a year prior to the beginning of contracted energy supply, the correction of the maximum price should be considered as per the last value published in the Broad-based Consumer Price Index (IPCA) until the date the auction is held.
The board also decided that after holding three auctions with the new systematic, a public hearing will be held to analyze the results.(PG/CV/GL).
*Adjustment auctions: These are held for the punctual contracting of existing energy by distributors, and they can be held during the year of supply, limited to 1% of load (demand).
**Annual reference value (VR):Value used to regulate the transfer pricing to tariffs for final consumers for electricity acquisition costs, as described in art.34 of Decree no. 5.163, of 2004.
