A public hearing in the document exchange modality has been opened with the aim of obtaining contributions to the proposed amendment Trading Procedure PdC AC.02 – Surplus and Deficit Compensation Mechanism (MCSD), and for assignment and reduction of electricity amounts in Power Trading Agreements in Regulated Environments (CCEAR). Contributions may be submitted until October 27 via e-mail to cp007_2011@aneel.gov.br.
The proposal under hearing encompasses the amendment to the Trading Procedure – PdC AC.02, pursuant to Item I of Article 8 of the Annex to Normative Resolution 109/2004. The amendment is needed for the execution of more than one processing in in the MCSD at 4% per year.
According to Decree 5,163/2004, the CCEARs arising from existing power auctions should provide for the possibility of reducing the amounts contracted at the sole discretion of the distribution agents. This may occur due to the financial year, potentially free consumers, the option of purchasing power by another supplier, or other market variations. Each year, there may be a reduction of up to 4% of the initially contracted amount, irrespective of the term of the agreement, commencement of supply, effectively reduced the amounts in previous years, and increases in power acquisition resulting from agreements signed prior to March 16, 2004, according to Act 10,848/2004.
