The National Energy Agency (ANEEL) starts, next year, a new step in their process of decentralization. All current agreements with state agencies will be terminated until 12/31, and new cooperation agreements, with updated methods of management, are expected to take effect from 01/01/2012. ANEEL’s new agreements with Agência de Regulação e Controle de Serviços Públicos do Estado do Pará (Arcon), Agência de Regulação dos Serviços Públicos Delegados do Estado de Pernambuco (Arpe), Agência Reguladora de Saneamento e Energia do Estado de São Paulo (Arsesp), Agência Reguladora de Serviços Públicos do Estado de Alagoas (Arsal) and Agência Reguladora de Serviços Públicos de Santa Catarina are already in the process of being signed.
The termination of the current cooperation agreements follows Law No. 9.427/1996, created by ANEEL, which provides, in paragraph 4 of Article 20, the deadline of 12/31/2011 for the duration of these instruments. The agreements to be signed following the assumptions of Normative Resolution No. 417/2010, whose text provides updated parameters for the planning and execution of complementary activities of regulation, control and supervision of public electric power, according to the joint management of public services.
As of 2012, the demands on state agencies will be by product, i.e., for specific services with a schedule of hours defined by ANEEL, which will receive the results and transfer the resources provided. This methodology also encourages efficiency and control of public services, and reduces the need for frequent audits by ANEEL on state agencies.
After the conclusion of new agreements, negotiations for the signing of the goal contracts will be initiated. These instruments demarcate the activities to be performed under each agreement with the corresponding transfer of resources. Within ANEEL, the management of the decentralization process rests with the Superintendent of Institutional Relations (SRI), but the signing of goal contracts is under the responsibility of the Superintendent of Bids and Control of Contracts and Agreements (SLC).
