Standard on hydropower operation regime is approved

The executive board of the National Energy Agency (ANEEL) approved, in a public meeting today (12/06), a normative resolution establishing requirements and criteria for modifying the system of exploitation of concessions for hydroelectric power generation intended for public service (in accordance with § § 3, 4 and 5, Art. 20 of Law No. 10.848/2004). The resolution draft was the subject of Public Hearing No. 030/2011, held from 05/25 to 07/25, which received 50 contributions from 11 participants.

The resolution regulates the modifications referred to in paragraphs 3, 4 and 5 of Article 20 of Law No. 10.848/2004, with the wording given by Law No. 11.488/2007and No. 12.111/2009. Law No. 10.848/2004 ordered the unbundling of public utilities for electricity distribution that operates in the National Interconnected System (SIN), i.e., the separation of distribution activities from generation and transmission. The resolution adopted states that with hydroelectric power exceeding 1MW and equal or lower than 50 MW should be linked to concessions arising from the process of separation of distribution activities or granted after October 5, 1988.

The hydroelectric projects that, by modifying the operation regime of Public Service (PS) for independent power producers (IPP), meet the criteria for classification in the condition of small hydropower plant (SHP), will receive the benefits to this type of venture.

Among them are the possibility of selling electricity in the Free Contracting Environment (ACL)* with special consumers and discount rates for use in transmission and distribution systems.

Already those hydroelectric plants that, with change with the system of exploitation, do not meet the criteria for classification in the condition of PCH, may also sell the electricity produced with special consumers.

Given the competitiveness gain by benefits coming from modifying the system of exploitation, it is expected an increase in installed capacity of generating capacity through the expansion and repowering of the plants.

Concessionaires, with request for modification of the operating regime underway in ANEEL, based on art. 20 of Law No. 10.848/2004, shall, after publication of Normative Resolution, supplement or update, if applicable, the documentation required by the new regulation. (BT/AO/FA)
