Today (20), the Brazilian Electricity Regulatory Agency (ANEEL) collegiate board approved the change in Resolution no. 433/2011, which altered the rite to be adopted, on a provisional basis, for those concessionaires that would undergo a tariff review in February 2012, by virtue of the late approval of applicable methodologies to the 3rd Cycle of Periodic Tariff Reviews.According to the decision, as a rule, all distributors in this situation will have the effects of the tariff review on the same date of the subsequent annual readjustment.In other words, the tariff will result from the effects of two calculations.
The simultaneous application of the tariff review and the readjustment will be conducted as follows:the review will be calculated with its original date as a reference.The sum paid over or under by consumers during the period the provisional tariff is in effect will be deducted or added in the final calculation of the readjustment.Thus, starting on the readjustment date, the consumer will already pay a corrected sum in relation to the sum paid during the provisional tariff period.
With this alteration, the tariffs in effect in 2011 for distributors with past due reviews will remain valid until the next contract anniversary date, starting March 2012. Thus, companies with review dates in February 2012 will have their tariffs reviewed and readjusted in 2013, keeping the tariff readjusted in 2011 for the year of 2012.
The following companies will be affected by this measure: Coelce (4/24/2011), Eletropaulo (7/4/2011), Celpa (8/7/2011), Elektro (8/27/2011), Bandeirante (10/23/2011), Piratininga (10/23/2011). CPEE, CSPE, Jaguari, Mococa, Santa Cruz (all five on 2/3/2012) and Santa Maria (2/7/2012).
In exceptional cases, the special rapporteur for the review of a specific distributor may propose a public hearing if deemed more appropriate for the review to take effect on a date prior to the readjustment.
The option for concatenating the periodic review and the readjustment dates was adopted as suggested by the Superintendence of Economic Regulation (SRE), responsible for calculating tariffs, after contributions from Public Hearing no. 067/2011, held 11/24 to 12/8. Resolution no. 433/2011 used to establish the extension of current tariffs on the condition that the tariff review processes projected for 2011 would be initiated soon after approval of the methodology for the 3rd Cycle of Periodic Tariff Reviews, which occurred in November.
Those electricity permissionaires in similar situations, whose tariff review is stopped due to review procedure discussions underway, should wait for a second phase of Public Hearing no. 019/2011, which is projected for March 2012. (BT/FA).
