The board of the National Energy Agency (ANEEL) decided to start a public hearing to assess the possibility of bilateral agreements (between the generator and the distributor), with the temporary suspension of Energy Trading Contract in the Regulated Environment – CCEARs from bids of auctions of new generation ventures.
The analysis of the topic, at the request of the Association of Electricity Distributors (ABRADEE), must comply with three fundamental aspects: a discussion of the legal feasibility of CCEAR suspension; identification of the need for imposition of conditions and criteria for approval of agreements of this nature; and the assessment of the need for the contract stacking criterion for defining the overcontracting cost to be revised.
Distributors argue that the measure will reduce the overcontracting and drive away the need for rebuilding the ballast by the generator, and said that the proposal would contribute to the low tariffs, to the extent that "the Difference Settlement Price – PLD scenario for a horizon short/medium term has a low PLD and that the CCEAR suspension will reduce the cost of power purchase contracts relating to those amounting to 10% of average monthly PLD."
As the decision affects consumers and agents, the Agency decided to receive input on the matter and issue regulations governing such transactions, standardizing the treatment for future demands.
