The National Energy Agency (ANEEL) granted in part the appeal by Companhia Energética de Minas Gerais (CEMIG) and decreased from from BRL 16.5 million to BRL 3, 3 million the fine for violations related to the calculation of indices of continuity in 2008 and 2009 and the crediting of compensation to consumers.The decision was taken by the board of the agency last Tuesday (02/07).

We also evaluated the resources of companies AES Sul Distribuidora Gaúcha de Energia S/A (AES Sul), Angélica Agroenergia Ltda and Centrais Candeeiro de Energia Ltda, which should be paid to ANEEL (directly or via state agencies), respectively, BRL 1, 19 million, BRL 126 000 and BRL 2800.In the case of AES Sul, the election for the conclusion of the Term of Conduct Adjustment (TAC) was not accepted by ANEEL.The decisions have the potential to appeal at the administrative level.Check the table below with details of the infractions. BRL 1,196,218.43 The Agency decided to meet and, on merit, to partially approve the appeal by AES Sul The penalty imposed by the Superintendency of Electricity Oversight Services (PES) was reduced from BRL 4,544,941.55 to BRL 1,196,218, 43.
Angélica Agroenergia Ltda. Noncompliance with the implementation schedule of TPP Angélica and start of its operation in the test without proper release by the Superintendency of Generation Service Inspection (SFG). BRL 126,076.72 The Agency decided to meet and, in substance, partially approve the appeal brought by Angélica Agroenergia Ltda.The penalty imposed by the State Agency for Regulation of Public Utilities of Mato Grosso do Sul (Agepan) was reduced from BRL 173,355.49 to BRL 126,076.72.
Centrais Candeeiro de Energia Ltda. Noncompliance with the implementation schedule of Small Hydropower (SHP) Camboatá BRL 2,806.62 The Agency decided to meet and, on merit, dismiss the appeal brought by Centrais Candeeiro de Energia Ltda.It kept the penalty imposed by the Public Services Regulatory Agency of Santa Catarina (Agesc), at BRL 2,806.62.
