Alteration ofthe Tariff Anniversay Date for Empresa Luz e Força Santa Maria approved.

The boardof the National Agency of Electrical Energy (Agência Nacional de Energia Elétrica – ANEEL) decided at its public hearing today (March 27th) to change thedate for tariff review and annual adjustment for Empresa Luz e Força Santa Maria (ELFSM), located in the state of Espirito Santo, Brazil. The new anniversary date was announced to be August 15th. It was also decided that the distributor’s existing tariffs would be extended to that same date. The decision was made so that the concessionaire can adjust its tariff anniversay date to its supplier’s – the Espírito Santo Centrais Elétricas S./A. (Escelsa) in the state of Espirito Santo. Revision is scheduled for August 07^th.

The last anniversary of the ELFSM tariff occurred on February 07^th and the Board of ANEEL approved to extend the current fees on January 31^st, in accordance with Resolution 471/2011, since the procedures for the Third Cycle of Periodic Tariff Review were approved in November 2011 and there was no time for the calculation of data associated with the distributor. The Agency has proposed the extension to the company's contractual anniversary date to August 15^th, since the tariff calculations regarding Escelsa affect the A parcel of the ELFSM rate. The discussion was the subject of Public Hearing number 12/2012, held from March 01^st to March 16^th, and four contributions were recorded in the period.

With the decision, the ELFSM will have its Third Periodic Tariff Review running from August 15^th on, with retroation of economic and financial effects to the referential date of February 07^th. An instrumental device was created in the review for the calculation of the financial component which refers to the difference between the extended and defined rates presented in the tariff review on the market during the period of February to July of this year, to be contemplated in the tariff adjustment following the review. For the first rate adjustment in 2013, costs for Plots A and B between the period of February 2012 to July 2013 will be considered . (BT / DB)
