Attorney General?s Office decision validates criteria for the third round of tariff revisions

Last Friday (April 13th),  the 3rd  Coordination and Review Board of the Attorney General's Office (PGR/Brazil) decided to validate the methodology of the third round of tariff revisions regarding the calculation of weighted average cost of capital (WACC). The understanding of the (AGO) is that the methodology adopted, in accordance with Resolution No. 457/2011, by National Agency of Electrical Energy (ANEEL), does not affect the tax policy of tax incentives of the Superintendency for Development of Amazonia (SUDAM) and the Superintendency for the Development of Northeast (SUDENE).

After the decision, ANEEL may include the tax rebate in the return rate calculation, thus applying lower rates for consumers in the regions of Sudan and Sudene.

Last week, the president of the Superior Court of Justice (STJ/Brazil),  Minister Ari Pargendler, had granted judgment in favor of ANEEL by accepting the agency's request that the effects of the rule relating to the SUDAM and SUDENE tax incentive returned in force after suspension  obtained in court by the Brazilian Association of Electricity Distributors (ABRADEE) .
