Interested parties may contribute to the discussion on the procedures for requesting consent to change incorporation articles, by service providers of electricity. The matter will be in public hearing from April 26thto May 25th. Contributions should be sent to the e-mail: ap028_2012@aneel.gov.br.
The proposal anticipates, for the transmission and distribution agents, that the changes subject to prior approval process* will be those on corporation, capital reduction, dissolution, movable and immovable assets, relations with controllers, its subsidiaries or affiliates and other subsidiary or affiliate companies of common control.
For concessionaires providing public services on generation of electricity, the prior approval by ANEEL to amend the Articles of Incorporation won’t be mandatory, as currently there is no such requirement for independent producers. However, they should communicate the changes implemented to allow further control by the agency.

*Priorapproval: transactions performed by agents, whichrequire prior approval by ANEEL. They are mostly authorized by the technical area, however in some cases, they may also be submitted to the deliberation of the Board of ANEEL.
