Norm on procedures for reimbursement for electrical damage

New procedures for requesting and receiving reimbursement for electrical damages were approved by ANEEL’s collegiate board in a meeting held last Tuesday (7/3). The new regulation is part of Module 9 of the Distribution Procedures (PRODIST) and it aims at standardizing how distributors treat requests for reimbursement for electrical damage, order processing, responses to consumers, reimbursement mode and keeping information for future verification.

The approved norm alters Chapter XVI of Normative Resolution no. 414/2010 which details how to apply the norm for reimbursement for electrical damage.The new regulation was approved to provide regulatory transparency for ensuring impartiality and safety in analyzing orders, guaranteeing process appropriateness and facilitating norm interpretation by consumers, distributors and state member agencies.

The resolution was in public hearing from 5/26/11 to 7/27/2011, with physical presence, held at the Agency head offices on 7/6/11. Twenty-two contributions were received from sector agents during the hearing period.A technical note is available on the ANEEL site with the results of public hearing no. 34/2011.

The new norm does not alter the periods for reimbursement which remain the same as those listed by Resolution no. 414/2010. After analyzing the request, the distributor has up to 45 consecutive days to reimburse the consumer if a relationship is determined between damage to the equipment and the problem that occurred in the system.Within this period, the utility has up to 10 days to inspect the equipment; up to 15 days after the inspection to communicate the request result to the consumer and 20 more days to make the reimbursement in cash for repairing or replacing the equipment, if necessary.For household appliances used to preserve perishable foods, such as refrigerators and freezers, the inspection shall take place in up to one workday.(DB/PG)
