Rules to thermoelectric plants that use national mineral coal changed

Brazilian Electricity Regulatory Agency(ANEEL) Board of Directors approved today (07/17) a review of the Normative Resolution n° 129/2004, concerning the fuel reimbursement by the Energetic Development Bill (CDE, in Portuguese) by thermoelectric plants in the National Interconnected System (SIN, in Portuguese) that utilize mineral coal. The approved normative determines the methodology to be applied so these ventures can be reimbursed with CDE resources, by the consumption cost of fuel to the thermoelectric generation, up to the 100% (one hundred percent) of the correspondent expenses.

The regulation establishes that the responsible agents for CDE beneficiary generation ventures must submit to Centrais Elétricas Brasileiras S./A. (Eletrobras) and to the National Electric System Operator (ONS, in Portuguese) until October 31st every year, the gross generation of electric power predicted for the following year, in a monthly basis, conditioned to the sum of contracted fuel. Generating plants should also forward to Eletrobras and ONS the predicted gross and net specific consumption of primary and secondary fuel of the plant, the correlation between the volume of secondary fuel spent and the electric generation of electric power and/or the number of starting points of the plant and the quantity of fuel in storage predicted for the beginning of the following year. Eletrobras will be responsible to forward to ANEEL, until December 1st of every year, the prediction of the following year of the quantity and cost of the fuels of the thermoelectric plants that use national mineral coal for CDE reimbursement, considering the electric power generation predicted, consumption and price of the fuels, including the price limits of secondary fuels and the reimbursement reduction by the energetic efficiency criteria and compliance to the annual generating mark of the generating plant.

The reimbursement to the generating agents will be made by Eletrobras, conditioned to CDE utilization resources schedule and to the availability of these resources with national mineral coal destination. From January 1st of 2016, it will be applied a percentage of the reimbursement of the effective consumption of the primary and secondary fuels, as the energetic efficiency criteria predicts, calculated according to the formula presented in the normative.

The CDE beneficiary generators will be obliged to implement, up to 16 months after the publication of the resolution, the CDE Operational Data Collection System, designated to measure, store and make it available the data concerning the fuel consumption for reimbursement. Eletrobras will determine the minimum technical requirements to the system, to be presented to ANEEL up to 120 days after the publication of the resolution, and will also ratify them in the generating plants, the development of the application and management of the data collected.

For cost of secondary fuel consumption reimbursement, Eletrobras will have as a limit the value spent in fossil fuel as reference price, meaning, the average value of the local market (city where the plant is located at, or the nearest city  in case there isn’t a research of the local market), as published in the National Agency of Petroleum, Natural Gas and Biofuels (ANP, in Portuguese) site. As the reimbursement of the cost of mineral coal consumption, the beneficiary agent must prove Eletrobras, within one year of the publication f the resolution and every five years, the reasonability of the price to acquire fuel established in the following supplying contract.
