The executive board of the National Electric Energy Agency (ANEEL) approved last Tuesday (09/18), the proposed regulation of procedures for calculating the Reference Rate Updated (TAR) and the charge sector Compensation for Use of Water Resources (CFURH). The proposal was the subject of Public Hearing 059/2012 for the period from July 26 to August 27 this year.
The CFURH and the TAR are seen as submodules 5.9 and 6.6, respectively, of the Rate Regulatory Procedures (PRORET), which aim to strengthen regulations on rate processes. The procedures of submodule 5.9 applies to public utilities of electricity distribution holders of concession or permits for any hydraulic potential for the production of electricity.
Since the procedures of Submodule 6.6 applies to all public utilities of electricity distribution that hire hydraulic power source which are not those concluded with the Itaipu Binacional and those related to electricity imports.
During the hearing, three contributions were received from the following agents: Associação Brasileira das Empresas Geradoras de Energia Elétrica (ABRAGE), Associação Brasileira dos Produtores Independentes de Energia Elétrica (APINE) and Companhia Energética de Minas Gerais (Cemig).
The agency's board decided to accept contributions relating to the inclusion, in the calculation, of the System Service Charges paid by generators when the tanks reach the minimum level set by Risk Aversion Curve (CAR), and the charge related to the modification of the regime of the concession for hydroelectric exploitation aimed at public service, according to Normative Resolution No. 467, from 2011, if the Utility chooses to convert it to Independent Producer.
