The Board of Directors of the Brazilian Electricity Regulatory Agency (Agência Nacional de Energia Elétrica – ANEEL) approved this past Tuesday (11/06) a Public Hearing to discuss the review of the Updated Reference Tariff – TAR [from the Portuguese, Tarifa Atualizada de Referência], in effect from January 1, 2013 to December 31, 2013. The value proposed in hearing is R$ 75.45/MWh, being that in the first review of the Tariff, in 2004, the value was set at R$ 52.67/MWh, and in the second, in 2008, at R$ 62.33/MWh.
Decree n° 3.739, dated 2001, established the creation of the Updated Reference Tariff – TAR [from the Portuguese, Tarifa Atualizada de Referência], which multiplied by the amount of energy of hydraulic origin effectively verified (in MWh), generate the total value of the energy produced for financial compensation purposes. According to Law n° 7.990, dated 1989, the financial compensation is designated to the States and Cities for the usage of their hydric resources for purposes of generation of electricity.
Resolution n° 66, dated 2001, established that the TAR should be readjusted annually based on the economic indicator adjusted to the specificities od the electricity services to be determined by ANEEL. Besides this, it was established that its value should be reviewed every four years.
