The deadline for submission of contributions to Public Hearing 110/2012, which aims to discuss the amendment of Normative Resolution 411/2010, addressing the adjustment auctions for electricity purchase, is open until the 1/21/2013. The measure was approved by the Board of the Brazilian Electricity Regulatory Agency (ANEEL) during a Public Meeting held on 12/18/12.
According to the Decree 5163/2004, the total amount of power to be contracted in specific auctions for adjustment contracting by the distribution agents shall not exceed one percent of each agent’s total contracted load. Concessionaires, permit holders, generation authorization holders, including those under federal, state and municipal control, and electricity sale and import authorization holders can participate in these bidding processes as sellers.
According to the standard, contracting from adjustment auctions should be formalized between the parties directly involved, for delivery of power in the distribution agent’s submarket, through bilateral agreements registered at ANEEL and the Electricity Trade Chamber (CCEE). Also according to the Decree, agreements arising from adjustment auctions should provide for commencement supply of the electricity contracted within four months, which comprise auction agreement.
The purpose of the hearing is to discuss the details and propose modifications to the public notices of adjustment auctions.
