The board of the Brazilian Electricity Regulatory Agency (ANEEL) has approved the draft normative resolution providing for the implementation of a Regulatory Impact Analysis (RIA) by the Agency. The matter was the subject of the Public Hearing 64/2012 and the Public Hearing for the Internal Public (API) 01/2012.
The resolution establishes the mandatory RIA prior to issuance of any normative act by ANEEL. The impact analysis defines the subject of the new normative act, identifies its purpose and estimates the expected benefits and costs of publishing. When establishing the mandatory nature of AIR, ANEEL seeks to provide more predictability to regulation and extend transparency and effectiveness of the factors that motivated the publication of a regulation.
The 78 contributions received during the hearing were unanimously favorable to the implementation of the procedure. According to the contributions, the Agency decided that, in order not to hinder the editing processes of normative acts, the depth of the AIR should be proportional to the relevance of the matter to be covered, provided that it meets the minimum requirements of the standard. In addition, a paragraph was added to Article 4 of the standard, stating that the parameters for cost-benefit analysis should be appropriate to each case, observing the principle of proportionality.
