Resolution on Regulatory Impact Analysis is published in the DOU

Fonte: ANEELNormative Resolution No. 540, dated March 12, 2013, which handles the carrying out of the Regulatory Impact Analysis (AIR, Análise de Impacto Regulatório) by the Brazilian Electricity Regulatory Agency (ANEEL – Agência Nacional de Energia Elétrica) was published today (04/08) in the Diário Oficial da União (DOU) [daily official government newpaper]. The Resolution approves ANEEL Organization Norm No. 40/2013. Check herethe publication.

The subject was theme of Public Hearing No. 64/2012and Public Hearing for the Internal Public (API) No. 01/2012. The resolution determines the mandatory realization of the AIR prior to the expedition of any normative act by ANEEL.
The impact analysis defines the object of the new normative act, identifies its purpose and estimates the expected benefits and costs due to its editing. In establishing the mandatory AIR, ANEEL searches to allocate more predictability to regulation and extend transparency and effectiveness of the factors that motivated the publication of a regulation.
The 78 contributions received during the hearing were favorable to the implementation of the procedure. According to the contributions, the Agency decided that the depth of the AIR should be proportional to the relevance of the matter to be regulated, as long as it fulfills the minimum requirements foreseen in the norm. Besides this, the provision was added that the parameters for the cost-benefit analysis should be proper for each concrete case, observing the proportionality principle. (DB)
