The Brazilian Electricity Regulatory Agency (ANEEL – Agência Nacional de Energia Elétrica) will hold on May 10, at 10 a.m., at BM&FBOVESPA headquarters, in São Paulo, Transmission Auction No. 01/2013. Ten lots will be tendered, composed of 5017 kilometers (km) in transmission lines and substations with a total of 1,200 mega-volt-amperes (MVA) of power.
The new facilities will require investments of approximately R$ 5.3 billion, generating 18,356 direct jobs. The period of completion is 22 to 36 months and the concession contracts are for 30 years.
Seventeen transmission lines and 4 substations will be tendered located in 11 states. They are: Ceará, Goiás, Maranhão, Pará, Paraíba, Paraná, Pernambuco, Piauí, Rio Grande do Norte, São Paulo and Tocantins. The maximum reference Allowed Annual Revenue (RAP – Receita Anual Permitida)* to be paid to the entrepreneurs, determined in the edict, is R$ 586 million. The winners will be the applicants present the lowest RAP price per lot. See here the description of the lots. Lots H and I are for the beginning of flow of energy to be produced in the Belo Monte Hydroelectric Plant.
In the event, the participation is not allowed, individually or in consortium in which it holds more than 49% share, of companies with a history of systematic delay in implementation of transmission projects in the last three years, characterized by average time of delay in commercial operation facilities exceeding six months beyond the dates specified in the respective concession contracts or authorization acts. Nor may companies join that have received three or more penalties for delay in execution of transmission projects within the last three years, already with final decisions on the administrative level. The list of companies that may not participate in the auction because of these restrictions will be announced along with the release of the auction notice.
Auction systematic – All applicants registered and qualified to compete in the lot must submit financial bid to the auctioneer at the time of the event, including those who may have lost interest in the dispute – in which case the participant must place the envelope a presentation refusal form. The financial proposal shall not exceed the Reserve Revenue, which corresponds to 95% (ninety five percent) of the RAP. If the difference between the lowest bid and the other bids exceed 5%, the lowest applicant wins the bid. If the difference is less than or equal to 5% or if there is a tie between the smaller bids, there will be a live round, in which the auctioneer may set minimum values to be offered between one bid and another. The applicant who submits the lowest value will win. In case of no bidder bidding live, the winner will be the one who has submitted the lowest value per envelope. If there is a tie in figures presented per envelope without live bids, the winner will be determined by drawing promoted by the session director. To promote the contest, the possible exclusion of the lot may occur for which there is only one bidder able to compete, after manifestation of the Ministry of Mines and Energy (MME).
Sureties– To participate in the auction, applicants will land sureties of up to 1% of the investment value estimated by ANEEL, with validity of 180 days. The Faithful Compliance Surety is presented only by the winners of the auction, replacing the previous surety. It corresponds to 5% of the investment value and should be contributed in up to two business days prior to signing the contract.
Schedule– By the edict schedule, the winning applicants shall deliver the documents for the qualification phase in the period of 5/13 to 5/17, at BM&FBovespa. By 05/29, ANEEL’s Special Tender Committee (CEL – Comissão Especial de Licitação) shall disclose the qualification result. The final term for filing an appeal is 06/06/2013. The homologation of the result and award of the concession are planned for 06/18/2013. The final term for delivering the schedule and budget for construction of the installations in 06/24/2013, date on which the SPE or transmission concessionaire documents demanded for the concession contract should be delivered. Two working days before the date to be schedules for signing the concession contract, the entrepreneurs shall deliver, at ANEEL, the faithful compliance surety. The contracts shall be signed up to 14 days after the date of summoning.

*Reference Allowed Annual Revenue (RAP) –is an annual revenue that the transmitter will have right to for providing public service of transmission to the users, starting with its installations entering into commercial operation. Its value is obtained as result of the auctions, with annual updating by the Extensive Consumer Price Index (IPCA – Índice de Preços ao Consumidor Amplo) by the Instituto Brasileiro de Geografia e Estatística (IBGE) and review every five years, in the terms of the concession contract.
